2. Amendments to the Original Agreement

5. Continuing Effect and Reservation of Rights

5.2 Nothing in this Agreement constitutes a waiver of any breach of the Original Agreement occurring before the Amendment Date, whether or not known to the parties, and each party reserves all rights in respect of any such breach.
5.3 No further variation of the Original Agreement is effective unless made in writing and signed by or on behalf of each party.
5.4 A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms, save that any third party entitled to enforce a term of the Original Agreement retains that right as amended.
