4. Standard Terms, Transparency and Incorporation
4.1 These terms are the Supplier's standard written terms and are offered on a take it or leave it basis; the Customer acknowledges that no individual negotiation of any term has taken place.
4.2 The Supplier shall make these terms available to the Customer in a durable medium before the Customer is bound, and shall present them in plain and intelligible language as required by section 68 of the Consumer Rights Act 2015.
4.3 Any term which is not transparent and prominent within the meaning of section 64 of the Consumer Rights Act 2015 shall not be treated as defining the main subject matter of the contract or as setting the price, and shall remain assessable for fairness.
4.4 If any term is found to be unfair under Part 2 of the Consumer Rights Act 2015, that term shall not bind the Customer and the remainder of these terms shall continue in force so far as practicable.

9. Variation of these Terms by the Supplier
9.1 The Supplier may vary these terms only for a valid reason stated in the notice of variation, being a change in law or regulation, a change in the cost of providing the Services, or a change to the Services notified in advance.
9.2 The Supplier shall give the Customer at least [30] days' written notice of any variation before it takes effect, specifying the varied term and the reason for the change.
9.3 If a variation is to the Customer's material disadvantage, the Customer may end this contract without charge by giving written notice at any time before the variation takes effect, and the Supplier shall refund any sums paid for the unexpired period.
9.4 The Supplier shall not vary the price payable during the [minimum term] except in accordance with clause 9.1 and clause 9.2.
