What is a Venue Hire Agreement?
A Venue Hire Agreement sets out the terms for renting a space, from conference rooms to wedding venues. It's a legally binding contract between the venue owner and the person or organization booking the space, covering essential details like dates, costs, and permitted activities.
These agreements protect both parties under English contract law by clearly stating payment terms, cancellation policies, and each side's responsibilities. They typically include specific rules about capacity limits, insurance requirements, and any restrictions on noise, decorations, or third-party suppliers. Most venues in England and Wales won't hand over the keys without one signed.
Sample clauses: standard wording in a UK venue hire agreement
6. Cancellation and Postponement
6.1 The Hirer may cancel this Agreement at any time by written notice to the Venue Owner, and the cancellation charge set out in clause 6.2 shall become immediately due, the deposit of [£X] being applied towards it.
6.2 The cancellation charge is [25]% of the Hire Fee where notice is received more than [90] days before the Hire Date, [50]% where notice is received between [90] and [30] days before the Hire Date, and [100]% where notice is received less than [30] days before the Hire Date.
6.3 The parties agree that the charges in clause 6.2 are a genuine pre-estimate of the Venue Owner's loss, reflecting the difficulty of re-letting the Venue at short notice, and are not a penalty.
6.4 Where the Hirer requests a postponement to an alternative date within [12] months and the Venue Owner agrees in writing, the Venue Owner shall transfer sums already paid to the new booking, subject to an administration fee of [£Y] and payment of any increase in the Hire Fee applicable to the new date.
9. Insurance, Damage and Indemnity
9.1 The Hirer shall maintain public liability insurance with a reputable insurer of not less than [£5,000,000] per claim covering the Hire Period, and shall produce the certificate of insurance to the Venue Owner at least [14] days before the Hire Date.
9.2 The Hirer shall be liable for all loss of or damage to the Venue, its fixtures, fittings and contents caused by the Hirer, its guests, contractors or suppliers during the Hire Period, excluding fair wear and tear.
9.3 The Hirer shall indemnify the Venue Owner against all claims, losses and reasonable costs arising from the Hirer's use of the Venue, its breach of the House Rules, or any act or omission of its guests or third-party suppliers.
9.4 Nothing in this clause limits either party's liability for death or personal injury caused by negligence, for fraud, or for any other liability which cannot lawfully be limited.
