What is a Land Use Agreement?

A land use agreement (sometimes called a land lease agreement) sets out the terms for using someone else's land for a defined purpose. It records exactly what activities are allowed, how long the lease term runs, what each party must do, and what happens at the end. When the arrangement grants exclusive possession for a fixed term, it works as a land lease; when it grants limited permission without possession, it works as a licence.

These legally binding contracts are common in both rural and urban settings across England and Wales, and they protect landowners and users alike. They cover farming and grazing rights, temporary event spaces, storage, access paths, and construction site access. The agreement must comply with local planning laws and often needs registration with HM Land Registry to be fully enforceable. Registration is governed by the Land Registration Act 2002.

A term lease might run for a fixed number of months or several years, and the wording should state whether payment falls due each month or on another schedule. Read every clause before you sign so both parties know what they are responsible for. You can draft one free from a template and have both parties sign, or generate a tailored version with GenieAI. Related documents include the lease agreement and the rental agreement for standard property lets.

4.2 The Grantee shall not carry out any development on the Land within the meaning of section 55 of the Town and Country Planning Act 1990, and shall at its own cost obtain and maintain every consent, licence and permission required for the Permitted Use.
4.3 The Grantee shall comply with all statutory requirements affecting the Land or the Permitted Use, including the Environmental Protection Act 1990 and the Occupiers' Liability Act 1957, and shall not do anything which causes a nuisance to the Grantor or to any adjoining owner or occupier.
4.4 The Grantee shall on the Expiry Date remove all its equipment and materials and reinstate the Land to the condition recorded in the Schedule of Condition, fair wear and tear excepted.

5. Status of this Agreement
5.1 This Agreement is a personal licence only and does not create any tenancy, lease or other estate or interest in the Land, and the Grantor retains possession and control of the Land at all times.
5.2 The Grantee shall not have exclusive occupation of the Land, and the Grantor and those authorised by it may enter the Land at any time for any purpose.
5.3 The parties confirm that this Agreement does not constitute a farm business tenancy under the Agricultural Tenancies Act 1995, and that Part II of the Landlord and Tenant Act 1954 does not apply.
5.4 The Grantor may terminate this Agreement by giving [notice period] written notice to the Grantee, and immediately on any breach of clause 4 which is not remedied within [remedy period] of notice.

Frequently Asked Questions

When should you use a Land Use Agreement?

Use a land use or land lease agreement any time you need formal, documented permission to use someone else's land. Common cases include setting up a temporary market stall, running cables or services across neighbouring land, leasing a field for grazing, or using private roads to reach a construction site. It matters most when the arrangement lasts more than a few days or involves commercial activities.

These agreements are essential when local planning regulations require a documented land use permission, or when several parties need clarity on their rights over the term of the lease. If you want to lease land for months at a time rather than a single day, the agreement should fix the term, the monthly rent, and who is responsible for maintenance and services. A clear agreement prevents disputes by defining boundaries, permitted activities, maintenance duties, service responsibilities and liability, and it saves both time and cost later. Teams without an in-house lawyer can put one in place and sign it without routing every deal to external counsel.

What are the different types of Land Use Agreement?

Who should typically use a Land Use Agreement?

  • Landowners: Private individuals, farmers, or companies who grant permission for others to use their land while maintaining ownership rights
  • Local Authorities: Often involved in approving Land Use Agreements and ensuring compliance with planning regulations
  • Commercial Tenants: Businesses needing land for specific purposes like events, storage, or operations
  • Solicitors: Draft and review agreements to ensure legal compliance and protect client interests
  • Land Agents: Negotiate terms and manage agreements on behalf of landowners or tenants
  • Planning Consultants: Advise on permitted uses and help secure necessary permissions

How do you write a Land Use Agreement?

  • Property Details: Gather exact boundaries, land registry details, and any existing rights or restrictions
  • Intended Use: Document activities, the lease term, and any seasonal or time-based limitations
  • Party Information: Collect full legal names, addresses, and company details for all involved parties
  • Local Regulations: Check planning permissions and zoning requirements for proposed activities
  • Access Rights: Define entry points, shared facilities, service arrangements, and maintenance responsibilities

  • Signature Block: Space for dated signatures of all parties

What's the difference between a Land Use Agreement and a Shared Use Agreement?

A Land Use Agreement is often confused with a Shared Use Agreement, but they serve distinct purposes in property law. While both deal with property access, their scope and legal implications differ significantly.

  • Legal Authority: Land Use Agreements grant comprehensive rights over specific land parcels, while Shared Use Agreements typically focus on shared facilities or spaces within a property
  • Duration and Scope: Land Use Agreements often involve longer terms and broader rights, including development or commercial use. Shared Use focuses on concurrent access arrangements
  • Regulatory Requirements: Land Use Agreements frequently need planning authority approval and Land Registry registration. Shared Use Agreements rarely require such formal oversight
  • Exclusivity Rights: Land Use Agreements can grant exclusive possession, while Shared Use inherently involves multiple parties sharing access
  • Financial Terms: Land Use typically involves substantial rent or fees, whereas Shared Use often focuses on cost-sharing arrangements
