Once I have signed, can I change my mind?

There is no general cooling off period for a residential property purchase in New Zealand. You can only get out of a signed agreement by cancelling in line with a condition that has not been satisfied, or if the other party agrees, so the conditions and their dates are what give you room to withdraw. Each condition carries its own deadline, and one that passes without being invoked is usually treated as satisfied. Does the agreement have to be in writing?

Yes. Section 24 of the Property Law Act 2007 provides that a contract for the disposition of land is not enforceable unless it is in writing, or its terms are recorded in writing, and signed by the party against whom it is being enforced. A verbal agreement to buy a house is not something you can hold the other side to, however clear the handshake felt. The same discipline applies to changes: a variation of the price, the settlement date or the chattels should be recorded and signed rather than agreed by phone. Who holds my deposit before settlement?

Where a real estate agent is involved, the deposit goes into the agency's trust account rather than to the seller, and its release is governed by the rules applying to agents' trust money. The agreement should state how much the deposit is and when it becomes payable, which is often on the agreement going unconditional rather than on signing. Paying it directly to the vendor instead removes that protection, so check the account details against the agency's own records before transferring anything. If the sale is cancelled, the deposit is dealt with under the agreement and the trust account rules, not by whoever happens to be holding it.

Do I need approval to buy if I am not a New Zealand citizen or resident?

Overseas persons generally need consent to buy residential land under the Overseas Investment Act 2005. Australian and Singaporean citizens buying land categorised as residential or lifestyle are exempt, but the exemption is narrower for permanent residents of those countries and for land that is sensitive for some further reason, such as being on an island or adjoining a beach. Does the same agreement work for a lifestyle block or a commercial property?

The standard residential form is drafted for houses, apartments and units. A farm, a lifestyle block or a commercial building raises different considerations, including whether the sale is registered for GST, what plant and equipment is included, and whether a tenant is already in occupation and on what terms. A form drafted for that type of property is the right starting point, because the residential version has nowhere to record those things. Unit title and cross lease properties sit in between: the residential form fits them, but the information you need before going unconditional differs from a standalone house on its own title.
