What must a contrat préliminaire contain to be valid?

How much deposit can the seller ask for on signing?
For an off-plan reservation, article R.261-28 of the Code de la construction et de l'habitation caps the dépôt de garantie at 5% of the price if the notarial deed is to be signed within one year, 2% if within one to two years, and nothing at all beyond two years.
